Our commitment

We are committed to providing safe, professional, reliable and courteous driving tuition in a supportive learning environment. These terms explain what you can expect from us and what we ask of you. Our aim is to provide every Pupil with a positive, enjoyable and supportive learning experience, helping them develop the knowledge, skills and confidence to become safe, responsible drivers for life.

Definitions

In these terms, “APS Driving School” means APS, a sole trader trading as APS Driving School; “Pupil” means the person receiving tuition; “Payer” means the person paying for tuition, whether the Pupil or someone else; and “Parent/Guardian” means a person with parental responsibility for a Pupil under 18.

 

1. Booking, payment and packages

By booking or attending lessons, the Pupil accepts these terms.

Individual lessons must be paid for before or at the start of the lesson unless agreed otherwise. Packages must be paid for in full before the first lesson. We will reserve the right topostpone or suspend tuition where payment is outstanding.

Packages are discounted and are valid for 12 months from the date of purchase. A package will expire after this period unless we agree otherwise in writing.

If the Pupil takes a break from lessons for more than two consecutive months and the price of the relevant package has increased during that period, the Pupil must pay the difference between the original package price and the current package price before resuming the remaining package lessons.

If a package expires or is otherwise ended before all lessons have been used, any refund due will be calculated by deducting the standard pay-as-you-go price applicable when each lesson was taken from the amount originally paid for the package. Any remaining balance will then be refunded to the Payer.

 

2. Cancellations and lateness

Please give at least 48 hours’ notice to cancel or rearrange a lesson.

Where less than 48 hours’ notice is given, or where the Pupil does not attend the lesson, the full agreed lesson fee will be charged or, where applicable, deducted from prepaid tuition.

We recognise that exceptional circumstances can arise. At the instructor’s discretion, a late-cancellation charge may be waived or reduced where there are circumstances outside the Pupil’s reasonable control.

If the Pupil is late, the lesson will normally still finish at the originally agreed time and the full lesson fee remains payable.

Late-cancellation charges apply only to cancellations or non-attendance by the Pupil.

We will make every reasonable effort to attend on time. Circumstances beyond the instructor’s reasonable control, including family emergencies and other unforeseen circumstances, may cause delay, postponement or cancellation. Where reasonably practicable, we will extend the lesson or make another arrangement so the Pupil is not disadvantaged.

No charge will be made for a lesson cancelled by APS Driving School, and we will try to rearrange it promptly.

 

3. Practical driving tests

Use of the APS Driving School vehicle for a practical driving test is at the instructor’s discretion. Where the vehicle is provided, a three-hour practical-test session is required, comprising up to two hours of tuition immediately before the DVSA test and use of the vehicle during the test.

As part of the instructor’s professional responsibilities as an Approved Driving Instructor (ADI) and agreement with the DVSA, we will not take a Pupil to test or provide our vehicle where, in the instructor’s reasonable opinion, the Pupil has not reached the standard required to take the test safely or is not adequately prepared.

The Pupil remains responsible for ensuring that they are properly prepared for the test and have all documents and requirements necessary to take it, including meeting the DVSA requirements relating to their driving licence, eyesight and punctuality.

The full applicable test-session fee must be paid before the practical driving test. 

If the practical driving test goes ahead as scheduled, the full three-hour test-session fee will be retained.

If the practical driving test is cancelled or postponed by the DVSA within 48 hours of the test, the booking will be charged at the normal two-hour lesson rate. Any amount paid in advance relating to the unused third hour will either be refunded or, where the test is rearranged, credited towards the payment due for the new test date.

If the Pupil cancels or postpones the practical driving test, or the test cannot proceed or is terminated, because of circumstances within the Pupil’s control that could reasonably have been prevented, including issues with documentation, eyesight, lateness or failure to provide the DVSA with sufficient notice, the full three-hour test-session fee remains payable.

If circumstances outside the reasonable control of the Pupil or instructor prevent the test from proceeding, the instructor will consider the circumstances and make reasonable arrangements regarding any tuition time already provided or reserved.

 

4. Fitness, safety and conduct

The Pupil must be fit and legally entitled to drive, meet the legal eyesight standard and wear any required glasses or contact lenses. APS Driving School may request sight of the Pupil's driving licence and may verify that the legal eyesight standard is met before or during tuition.

Tell us only about a medical condition, injury or medication where it may affect safe or lawful driving. The Pupil remains responsible for any DVLA notification required by law. 

Do not attend under the influence of alcohol, recreational drugs or medication that may impair driving. We may refuse, postpone or end a lesson where the Pupil appears unfit or impaired; the lesson will be treated as a late cancellation. Mobile devices must not be used while driving unless it is safe, lawful and directed by the instructor. Suitable footwear and clothing must be worn. We expect respectful behaviour from everyone and may end a lesson for unsafe, abusive, threatening, discriminatory or otherwise unacceptable conduct. Smoking and vaping are not permitted in the vehicle.

 

5. Vehicle and personal property

We will provide a roadworthy, insured and maintained vehicle, but cannot guarantee a replacement vehicle during breakdown, accident, servicing or repair. The Pupil should immediately report any suspected defect or safety concern relating to the instructor's vehicle during a lesson. We will take reasonable care to keep it safe and clean; the Pupil must treat it with reasonable care and respect. Accidental damage occurring as a normal part of learning is not charged to either party, but deliberate, reckless or misuse-related damage will be recovered from the responsible person.

The Pupil is responsible for securing personal belongings. We are not responsible for loss or damage caused by normal driving, emergency braking, steering or other safety action. Loose, valuable or fragile items should be stored safely; we will ask that they are secured or moved.

 

6. Refreshments, photographs and records

Complimentary sweets or refreshments are optional. Before accepting them, the Pupil must tell us about any relevant allergy, intolerance, medical condition or dietary requirement. We take reasonable care but cannot guarantee products are allergen-free or free from cross-contamination; we are not responsible where relevant information was not disclosed.

We may take photographs or videos of successful test candidates for promotional use only with the Pupil’s consent. A Pupil who does not wish to be photographed or filmed must tell us before this occurs. If consent is withdrawn, we will remove the material from platforms under our control as soon as reasonably practicable. Copies, cached images or archives held by third parties (including search engines and social platforms) are outside our control; removal requests must be made to the relevant third party.

We use TotalDrive for bookings, payments and lesson records; these records may be relied upon in a dispute. Your personal information is handled in accordance with our Privacy Notice.

 

7. Driving offences and communications

The Pupil is responsible for their driving while in control of the vehicle. If a road-traffic offence is alleged, we may be legally required to provide the Pupil’s name, address and relevant information to the police or another lawful authority. The Pupil is responsible for any resulting fine, penalty, endorsement or prosecution. The Pupil and Payer, if different, must tell us promptly of changes to their contact details.

 

8. Under-18s, payments and general

For a Pupil under 18, a Parent/Guardian must confirm acceptance of these terms before tuition begins. Where lessons are paid for by someone other than the Pupil, we will record that person as the Payer where contact details are provided. The Pupil may manage bookings and cancellations, but a late-cancellation charge may be deducted from the prepaid balance.

Where practicable, APS Driving School will send the Payer booking and late-cancellation notifications using the contact details provided.

We may update these terms; updated terms will be made available through TotalDrive, where acceptance is required before further use. These terms are governed by the law of England and Wales. If any part is unenforceable, the remaining terms continue to apply.

9. Dash Camera

For safety, security, insurance, and incident investigation purposes, this vehicle is fitted with a forward and rear-facing dash camera, which records video footage of the road ahead and the rear. The camera does not record the interior of the vehicle. Footage is recorded on a continuous loop and is automatically overwritten when the memory card becomes full. The length of time recordings are retained may vary depending on vehicle use. Footage is only kept longer where necessary, for example, in connection with an accident, insurance claim, or legal obligation.

 

10. Lesson duration and prices

Lessons are provided for a minimum duration of two hours.

Lesson prices are not fixed and may vary depending on the current rates, offers or packages available at the time of booking. The applicable price will be confirmed to the Pupil before the lesson or package is booked.

 

11. Complaints Procedure

If you are unhappy with any aspect of the service provided by APS Driving School, please contact APS Driving School as soon as reasonably practicable so the issue can be investigated at the earliest opportunity to try to resolve it.

6. TotalDrive and other service providers
 

We use TotalDrive to help manage bookings, payments and lesson records.

When you submit an enquiry or use TotalDrive in connection with your lessons, your information may be processed by TotalDrive on our behalf.

Our website is hosted by Wix, which may process information submitted through or collected from our website.

We may also use other service providers where necessary to operate the business, such as payment providers, accounting services, insurers or professional advisers.

Where another organisation processes personal information on our behalf, we take reasonable steps to ensure that your information is handled appropriately and securely.
 

7. When we may share your information
 

We will only share your personal information where there is a legitimate reason to do so.

This may include sharing information with:

  • TotalDrive and other service providers involved in providing our services

  • Payment or banking providers where necessary to process transactions

  • Our insurer where required in connection with an accident, claim or policy matter

  • Professional advisers where necessary

  • The DVSA or other relevant authorities where required to administer a driving test or comply with legal requirements

  • The police or other lawful authorities where we are legally required to provide information

  • Other organisations where disclosure is necessary to comply with the law or establish, exercise or defend legal claims

We do not sell or rent your personal information to third parties.
 

8. Dashcam footage
 

Our training vehicle is fitted with forward- and rear-facing dash cameras for safety, security, insurance and incident investigation purposes.

The cameras record the road ahead and behind the vehicle. They do not record the interior of the vehicle.

Dashcam footage may contain images of identifiable people, vehicles or other information and may therefore constitute personal data.

Footage is recorded on a continuous loop and is automatically overwritten when the available storage is full.

Footage will normally only be retained for as long as necessary. Where an accident, insurance claim, complaint, legal matter or other incident occurs, relevant footage may be retained for longer where reasonably necessary.

Dashcam footage will only be accessed or disclosed where there is a legitimate reason to do so, such as investigating an incident, dealing with an insurance claim, complying with a legal requirement or establishing, exercising or defending a legal claim.
 

9. Photographs and promotional material
 

We may occasionally take photographs or videos of pupils who have successfully completed their practical driving test for promotional purposes.

We will only use such photographs or videos for promotional purposes where the pupil has given permission.

You can withdraw your permission at any time by contacting us. If permission is withdrawn, we will remove the relevant material from platforms under our control as soon as reasonably practicable.

We cannot control copies, cached versions or archived material held by third parties, including search engines or social media platforms.


10. How long we keep your information
 

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, including where necessary to meet legal, accounting, insurance or regulatory requirements, or to establish, exercise or defend legal claims.

Different types of information may therefore be retained for different periods.

For example, lesson, payment and business records may need to be retained for longer than an initial enquiry.

Dashcam footage is normally overwritten automatically unless it is reasonably necessary to retain particular footage for an accident, insurance claim, legal matter or other legitimate purpose.
 

11. Keeping your information secure
 

We take reasonable steps to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access to personal information is limited to those who need it for legitimate business purposes.

However, no method of storing or transmitting information over the internet can be guaranteed to be completely secure.
 

12. Your data protection rights
 

Depending on the circumstances, you may have rights under UK data protection law, including the right to:

  • Ask for a copy of the personal information we hold about you

  • Ask us to correct inaccurate or incomplete information

  • Ask us to delete personal information where there is no good reason for us to continue processing it

  • Ask us to restrict how we use your information in certain circumstances

  • Object to certain processing, including processing based on legitimate interests

  • Request transfer of certain information to you or another organisation where the right to data portability applies

  • Withdraw consent where we are relying on your consent to process your information
